This Freeware License Agreement (the "AGREEMENT") is a legal agreement between you (the "LICENSEE") and BIOLOGIC INSTITUTE for the use of this software product ("SOFTWARE"). By using or storing (in part or in whole) this SOFTWARE on any digital device, you agree to be bound by the terms of this Agreement. You may not alter this SOFTWARE in any way. You may not modify, rent or sell this SOFTWARE, or create derivative works based upon this SOFTWARE. You may not distribute this SOFTWARE. The official download site will remain the only source of authorized versions of the SOFTWARE, all unauthorized versions being prohibited by this AGREEMENT.
This agreement shall be governed by the laws of the state of Washington, USA. If any portion of this AGREEMENT is deemed unenforceable by a court of competent jurisdiction, that shall not affect the enforceability of other portions of this AGREEMENT.
BIOLOGIC INSTITUTE EXPRESSLY DISCLAIMS ANY WARRANTY FOR THIS SOFTWARE. THIS SOFTWARE AND THE ACCOMPANYING FILES ARE PROVIDED "AS IS," WITHOUT ANY WARRANTY AS TO PERFORMANCE OR SUITABILITY, OR ANY OTHER WARRANTY WHETHER EXPRESSED OR IMPLIED. YOU, THE LICENSEE, AGREE TO ASSUME FULL RESPONSIBILITY FOR ANY CONSEQUENCES THAT MAY ARISE FROM THE USE OF THIS SOFTWARE. In no event shall BIOLOGIC INSTITUTE be liable for any consequential, incidental or indirect damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) resulting from the use of or inability to use this SOFTWARE, EVEN IF BIOLOGIC INSTITUTE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
